What stamp duty is calculated on
Stamp duty applies to the higher of: the agreement value (what you paid) or the state's ready-reckoner / circle rate (the government's notional fair value). For under-construction property at builder rates, the agreement value is usually used. For old resale properties, circle rates can be higher than market value, raising your duty bill.
Legal ways to reduce the bill
- Register in a female name (states with the discount: MH, DL, HR, UP, RJ, PB, BR, OR). Joint registration with majority female ownership often qualifies.
- Affordable housing concession: many states have lower rates for properties under ₹30-50 lakh. Check your state's policy.
- Avoid back-dating, NOC games, and "save stamp duty" schemes from brokers. These often involve under-reporting and can void the registration entirely under scrutiny.
